RECITALS

WHEREAS, SOLSPARK CREATIVE, hereinafter referred to as “THE PHOTOGRAPHER”, is engaged in the production of photographic content, including but not limited to photos, videos, and digital media “CONTENT” for sessions;

WHEREAS, the client, hereinafter referred to as “THE CLIENT,” agrees to participate and facilitate the creation of said CONTENT during their session;

WHEREAS, THE PHOTOGRAPHER wishes to use THE CONTENT for purposes including, but not limited to, marketing, promotional materials, portfolios, and other media platforms, both online and offline;

WHEREAS, THE CLIENT agrees to grant THE PHOTOGRAPHER certain rights regarding the use, publication, and distribution of THE CONTENT as detailed in this agreement;

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, and intending to be legally bound, the parties hereto agree as follows;

TERMS & CONDITIONS

THE CLIENT provides Jamie Solverson & SOLSPARK CREATIVE (THE PHOTOGRAPHER), and their assigns, licensees, successors in interest, legal representatives, and heirs the limited right to use images or photographs from the session in the manner(s) outlined below:

LIMIT OF LIABILITY: THE CLIENT releases THE PHOTOGRAPHER from any liability associated with the session coverage. This includes personal injury, loss of property, or any incidents that occur during the session coverage. THE CLIENT also relieves THE PHOTOGRAPHER from any third-party claims connected to the session.

AGE OF CONSENT: THE CLIENT confirms they are legally capable of entering this contract. This contract applies to all photography, where the nature of content will vary based on the session characteristics.

PROFESSIONALISM: THE PHOTOGRAPHER commits to a professional conduct during the session coverage. THE CLIENT agrees not to hold THE PHOTOGRAPHER liable for any misunderstandings related to the photography service.

CLIENT’S RESPONSIBILITY DURING SESSION: THE CLIENT agrees to cooperate with THE PHOTOGRAPHER to facilitate photography coverage. This includes providing access and assistance as needed for the successful execution of the session photography.

IMAGE SHARING: THE PHOTOGRAPHER may share images from the session in various media for promotional purposes, respecting any restrictions specified by THE CLIENT. THE CLIENT waives the right to inspect or approve versions of images used, trusting THE PHOTOGRAPHER’s discretion for sensitive content.

CREATIVE FREEDOM: THE PHOTOGRAPHER retains creative control over the final images, including editing decisions. Requests for changes by THE CLIENT may incur additional fees.

DIGITAL MANIPULATION: THE CLIENT acknowledges THE PHOTOGRAPHER’s right to edit images. THE CLIENT agrees not to alter final images provided by THE PHOTOGRAPHER.

OWNERSHIP OF IMAGES: THE PHOTOGRAPHER retains copyright of images from the session. Use of these images by THE CLIENT for commercial purposes requires written permission from SOLSPARK CREATIVE.

MONETARY GAIN FROM IMAGES: THE CLIENT agrees not to profit from the images without permission. Unauthorized sale or distribution of the images is prohibited.

SOURCING OF IMAGES: If THE CLIENT shares images online, proper credit to SOLSPARK CREATIVE is required. Failure to source images correctly may lead to legal action.

This Agreement is the complete understanding between THE CLIENT and SOLSPARK CREATIVE regarding all photography services and supersedes all previous agreements. Amendments to this Agreement must be in writing and mutually agreed upon.
